There is an organization called the UN’s Human Rights Council on the right of anyone who has suffered torture for up to 2 years if they report an event in which torture, including that of an official, was used in an official capacity, without the authorisation for the government. We don’t think you’re going to see what goes on if they have those records.

So let’s look at the circumstances surrounding this.

Firstly, we have a UN Human Rights Council, which is based in Geneva, that speaks out against torture. Of its members, almost all of them agree on basic principles. But we hear from people in the US who claim that some aspects of torture should be limited and that we should not make decisions about those provisions. We have a special rapporteur on torture appointed by the UN itself. And then the tribunal at St Paul’s (the Vatican) is chaired by an officer who is called the Holy See Special Adviser to the United Nations Human Rights Council, and, after that process, a special rapporteur on torture.

I want to make sure the same process that I was at St John’s University (for instance, where I taught English), that we set up as the Holy See special Adviser on Human Rights Council, is still going to continue as it should. What has happened is that the Human Rights Council has got to be able to provide this information to the UN, and to the Council and all that kind of information.

The UN Committee on the Rights of the Child has never been able to provide this information. It seems to me that it has gotten a little, in some quarters, taken back, so we didn’t have this information, I’m worried about that, but then the Human Rights Council gets involved and then they set up this Special Adviser on Human Rights and say, We have this case, we want to use it. And what we found, and what we feel the Commission has found quite broadly, is that, if the commission were to release these documents, it would have the legal authority to do so, but not that power.

Do you have any advice on how the Commission might respond to this

We have been dealing with this particular situation for some weeks. I had been in the Security Council for five years before I did this, and I was able to get it done from the US. And, in fact, I would urge everybody to go and contact me and talk with me about this matter.
